Daily Notices Wednesday 27 September 2016

*NEW* S1-6/Staff: SMOKING IN A PUBLIC PLACE.  It is disappointing from a health point of view to note we have a larger than usual group of young people who have started smoking, particularly within the school perimeter or near to it. There also appears to a misconception that it is okay for 16 or 17 year olds to smoke in public places. Below are the details of the legislation that explains what authority the Police have to deal with these issues.  This is a reminder to the youths that chose to smoke and the adults who choose to purchase the tobacco for them. If anyone requires any further information, please contact PC Boyce at Stranraer Academy – 01776 706484.

The Tobacco and Primary Medical Services (Scotland) Act 2010.

It is an offence for a person under 18 to purchase tobacco;

It is an offence for adults to buy tobacco for under 18s (proxy purchase);

The Police have the power to confiscate tobacco products from persons under 18 when they are – In a public place

The constable may require the person to give him/her

  1. The tobacco product or, as the case may be, the cigarette papers to them.
  2. The person may also require that person to supply their name and address.

IT IS AN OFFENCE IF THE PERSON FAILS TO COMPLY WITH THE ABOVE.

A CONSTABLE MAY ARREST ANY PERSON WHO FAILS TO COMPLY WITH THE ABOVE.
